PCCS and the Freedom of Information Act

Scottish Information Commissioner Decision 117/2009

Applicant: Mr Cooney
Mr Derek Cooney applied to the Scottish Information Commissioner for a decision as to whether the Police Complaints Commissioner for Scotland (PCCS) breached Part 1 of the Freedom of Information (Scotland) Act 2002 (FOISA) in dealing with his request for information. The request was in relation to the number of complaints received concerning Police Forces/Authorities in Scotland.
The Commissioner found that the PCCS had breached Part 1 of FOISA by wrongly withholding the information Mr Cooney requested until the investigation commenced.

Scottish Information Commissioner Decision 084/2009
Applicant: Mr David Emslie

Mr David Emslie applied to the Scottish information Commissioner for a decision as to whether the Police Complaints Commissioner for Scotland (PCCS) breached Part 1 of the Freedom of Information (Scotland) Act 2002 (FOISA) in dealing with his request for information.
The Commissioner decided that the PCCS complied fully with Part 1 of FOISA in dealing with Mr Emslie's request.
