The complainer asked the PCCS to review the manner in which Lothian and Borders Police dealt with 13 complaints. The complaints raised centred around the seizure of his relative's vehicle and the detention of one of the vehicle's passengers.

The Commissioner upheld one complaint relating to uniformed officers refusing to provide identification and wrote to the Association of Chief Police Officers Scotland (ACPOS) regarding the lack of guidance about this subject. The Commissioner noted that although the complainer had raised two of the complaints with the Lothian and Borders Police, these matters did not appear to have been considered. As such he recommended that the force record these as complaints about the police and provide the complainer with a response. The remaining ten complaints were not upheld as the review determined that the quality of complaint handling in respect of these matters was satisfactory.

The review also highlighted a number of learning points and areas for further consideration for Lothian and Borders Police and the police community in Scotland as a whole including the securing of relevant CCTV evidence when complaints are received.
